The plaintiff was rear ended by a commercial vehicle. She complained of back pain immediately and was transported to the emergency room. She was subsequently treated by her family physician and an orthopedist. About 11 months after the accident, the plaintiff’s orthopedist recommended a back surgery. The plaintiff was not able to have the back surgery due to an unrelated medical issue.
