Our client was a bicyclist who was struck by a vehicle at night. The plaintiff sustained a broken clavicle and leg as a result of the impact. The insurance company initially denied the case but the attorneys learned in discovery that the defendant was on his cell phone. The insurance company offered 96 percent of its insurance coverage after the firm received the defendant’s cell phone records.
